FR - Decree relating to digital asset service providers
On 22 November 2019 Decree No. 2019-1213 relating to digital asset service providers was published in the Official Journal.
For issuers who have received AMF token issue approval and for registered or approved digital asset service providers, this decree provides a remedy through the ACPR in the event of the non-observance by credit institutions of objective rules and not discriminatory governing access to the account.
The text of the decree, moreover, makes adjustments to the Monetary and Financial Code following the supervision of cold-calling and use of web banners, practices henceforth reserved for approved service providers or issuers having received approval to make their token issue. Finally, the text provides definitions of the various digital assets services established by the law and the applicable rules and procedures for a service provider to be registered or approved.
