EMIR REFIT – Update of RTS
The following elements were published in the EU OJ on 28 November 2022:
Delegated Regulation (EU) 2022/2310 amending the technical regulatory standards defined in Delegated Regulation (EU) no. 149/2013 concerning the value of the clearing threshold for positions held on OTC derivative contracts and on other OTC derivative contracts.
Delegated Regulation (EU) 2022/2311 amending the technical regulatory standards set out in Delegated Regulation (EU) No 153/2013 on temporary emergency measures for collateral requirements.
The new RTS will apply as of April 29, 2024.
The 20 December, the European Securities and Markets Authority (ESMA) clarified the legal provisions on reporting and data management under the amended EMIR rules and provided practical guidance on their implementation.
