EMIR – Cooperation arrangements between ESMA and CFTC

On 2 June 2016, ESMA and CFTC signed a memorandum of understanding ("MoU") establishing cooperation arrangements, including the exchange of information, regarding CCPs which are established in US and authorised or recognised by the CFTC and which have applied for EU recognition under EMIR.

On 2 June 2016, ESMA and CFTC signed a memorandum of understanding ("MoU") establishing cooperation arrangements, including the exchange of information, regarding CCPs which are established in US and authorised or recognised by the CFTC and which have applied for EU recognition under EMIR. The authorities within the context of this MoU, should provide each other with the fullest cooperation permissible under their laws and regulations in relation to ESMA’s assessment of compliance and monitoring of the ongoing compliance by the covered CCPs with the recognition conditions. The MoU is an arrangement between the CFTC and ESMA and not a collective arrangement with other EU authorities. It will not affect other arrangement agreed directly between other EU authorities and the CFTC.
