On 18 July 2017, the AMF published a Position-Recommendation laying down its requirements regarding the risks arising from the digital transition in the relations between service providers and their clients as well as the consequences for client behaviours.

On 18 July 2017, the AMF published a Position-Recommendation laying down its requirements regarding the risks arising from the digital transition in the relations between service providers and their clients as well as the consequences for client behaviours. This covers:

  • methods for information gathering and traceability (form and content of the questions asked, quality of the information gathered, updating and preserving said information);
  • exploitation of the information gathered (incoherent response management, ability to provide the client with justification as to the coherency of the services proposed);
  • resources and procedures implemented to strengthen procedures, and internal control systems for the companies concerned;
  • reputational risks related to the systematic misuse of data concerning a large number of clients or the deterioration of the data processing system;
  • security risks related to the preservation of private client data.
