ESMA Opinion on a European framework for loan origination by funds

On 11 April 2016, the European Securities and Markets Authority (ESMA) published an Opinion to the European Parliament (EU Parliament), the Council and the European Commission (EU Commission) on key principles for a European framework on loan origination by funds.

On 11 April 2016, the European Securities and Markets Authority (ESMA) published an Opinion to the European Parliament (EU Parliament), the Council and the European Commission (EU Commission) on key principles for a European framework on loan origination by funds. This Opinion takes place in the context of the Action Plan on Building a Capital Market Union (CMU) launched in September 2015 by the EU Commission and is part of the assessment of the need for a coordinated approach to loan origination by funds. The Commission intends to consult on the elements of a European framework on loan origination in the second quarter of 2016 and has asked ESMA to provide input as to the key issues on which the consultation could focus.

In line with the EU Commission’s request the Opinion only focuses on the activity of loan origination and excludes loan participation and loan restructuring. Furthermore the Opinion does not cover loan origination by alternative investment funds (AIFs) subject to the EuVECA, EuSEF or ELTIF Regulations.
