SFTR: Publication of Final Rules
On 22 March 2019, the delegated acts on reporting of EU securities financing transactions were officially published in the Official Journal of the European Union.
These regulations came into force on 11 April 2019. Like EMIR, all transactions falling within the purview of this Regulation (including repurchase agreements, securities and commodities lending or borrowing transactions, buy-sell back and sell-buy back transactions, and margin lending transactions) must be reported to a central repository. The effective date of these reporting obligations shall depend on the character of the reporting entity as set out in the following schedule:
13 April 2020 – Credit institutions (banks) and investment firms
13 July 2020 – CCPs and CSDs
12 October 2020 – Pension funds, insurance/reinsurance companies, AIFs and UCITSs
11 Jan 2021 – Non-financial institutions.
Level II measures under the Regulation focus primarily on the central repository's registration procedure, as well as the required content, format and information frequency when reporting transactions.
